Can I Hire an Attorney to Represent me at Mediation?

We often get phone calls from potential clients asking if they can hire us for representation at mediation, even though they started the process without an attorney. Sometimes a client decides to start a divorce case or other family law case “pro se,” meaning without an attorney, either to save money, or because the issues initially seemed to be less complex than it turned out. However, once a case gets started, many litigants realize the complexity of the proceedings and circumstances and change their minds.

Although each case is different, in most cases you can, and should, hire an attorney to represent you at mediation. While it is always best practice to hire a family law attorney before you initiate divorce proceedings or other family law proceedings, it is better to get sound legal advice late than not at all. In many cases, having legal representation at mediation can be the difference between a poor negotiation that leaves one party confused, or feeling ripped off, and a settlement agreement which resolves every legal issue and allows you to move on with peace of mind.
